General Terms and Conditions

1. Scope

The following General Terms and Conditions apply to all orders placed through our online shop.

2. Contracting Party, Conclusion of Contract

The purchase contract is concluded with Adaptonics/Curro Cachinero, Calle Vence 49a, 38540 Candelaria

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive confirmation by email once again.

3. Contract Language, Contract Text Storage
The language available for concluding the contract is German.

We do not store the contract text.

4. Delivery Terms

In addition to the stated product prices, shipping costs will also apply. You can find more information about the amount of the shipping costs in the respective offers.

We deliver exclusively by shipment. Unfortunately, it is not possible to collect the goods in person.

5. Payment
Our shop generally offers you the following payment methods:

Credit Card
When placing your order, you simultaneously provide us with your credit card details.
After verifying that you are the lawful cardholder, we immediately instruct your credit card company after the order is placed to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company, and your card is charged.

PayPal
During the ordering process, you will be redirected to the PayPal online provider’s website. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your access details, and confirm the payment instruction to us. After placing your order in the shop, we instruct PayPal to initiate the payment transaction. You will receive further information during the ordering process.
The payment transaction is then carried out automatically by PayPal immediately afterward.

SOFORT Bank Transfer
After placing your order, you will be redirected to the SOFORT Bank Transfer online provider’s website. To pay the invoice amount via SOFORT Bank Transfer, you must have an online banking account enabled for participation in SOFORT Bank Transfer with a PIN/TAN procedure, authenticate yourself accordingly, and confirm the payment instruction to us. You will receive further information during the ordering process. The payment transaction is then carried out immediately by SOFORT Bank Transfer, and your account is charged.

6. Transport Damage

If goods are delivered with obvious transport damage, please report such damage to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or contact us has no consequences for your statutory rights or their enforcement, particularly your warranty rights. However, you help us assert our own claims against the carrier or the transport insurer.

7. Liability for Defects and Warranties

The statutory liability for defects applies. Information about any additional warranties that may apply and their exact terms can be found with the respective product and on dedicated information pages in the online shop.

8. Liability

We shall always be liable without limitation for claims arising from damage caused by us, our legal representatives, or our vicarious agents

  • in the event of injury to life, body, or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the event of warranty commitments, to the extent agreed, or
  • to the extent that the scope of application of the Product Liability Act is opened.

In the event of a slightly negligent breach by us, our legal representatives, or our vicarious agents of essential contractual obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), liability shall be limited in amount to the foreseeable damage at the time the contract was concluded, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

9. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
